The Supreme Court of India has ruled that the Governor of a state has no discretion under Article 200 of the Constitution and must act according to the aid and advice of the Council of Ministers. This decision came in response to a petition filed by the Punjab government against Governor Banwarilal Purohit, who had delayed giving assent to several bills passed by the state assembly. The court emphasized that the Governor's role is to act on the advice of the elected government, and any delay in assenting to bills could be seen as a violation of constitutional norms. The ruling aims to clarify the powers and limitations of the Governor, reinforcing the principle that the Governor should not obstruct the functioning of the elected government.
