The Madhya Pradesh High Court has ruled that forcing a woman to undergo a virginity test is a violation of her right to live with dignity under Article 21 of the Indian Constitution. This decision came in response to a petition filed by an accused in a gang rape case, challenging the trial court's order for a potency test on him and a virginity test on the victim. The court emphasized that such tests infringe upon personal liberty and bodily integrity, and thus, are unconstitutional. The court also noted that while a potency test on the accused might be necessary for the trial, a virginity test on the victim serves no legal purpose and is an affront to her dignity.
