The Alliance for Automotive Innovation, representing major automakers, has filed a lawsuit against the National Highway Traffic Safety Administration (NHTSA) over a new regulation mandating automatic emergency braking (AEB) systems in all new cars by September 2029. The lawsuit claims that the NHTSA's rule, which requires vehicles to stop and avoid contact with a vehicle in front at speeds up to 62 mph and detect pedestrians in both daylight and darkness, exceeds the agency's legal authority and underestimates the technological and economic challenges involved. The group argues that the technology for pedestrian detection, especially at night, is not yet mature enough for widespread implementation, and that the costs of compliance could be significantly higher than estimated, potentially affecting vehicle affordability and safety improvements. The lawsuit seeks to have the rule vacated or modified, highlighting concerns over the feasibility and safety implications of the mandate.
